From ousted CEOs to nixed political campaigns due to bad behavior, some days it seems like professionalism and fairness were never the concerns of any industry – especially dealings between men and women in the workforce. The Probate and Trust Law Section's program will discuss and review an array of current issues including the following broader topics:  The implementation of the Public Access Policy of the Unified Judicial System of Pennsylvania for filings with the Orphans' Court and any ongoing issues experienced by practitioners  The status and significant changes of the proposed Pennsylvania Orphans' Court Rules for Guardianships.  The impact the Tax Cuts and Jobs Act of 2017 has on the income taxation of estates and trusts, in particular the elimination of miscellaneous itemized deductions.

The ADA Amendments Act and its state law equivalents (such as the PHRA) require employers to provide reasonable accommodations to employees – including those with disabilities – to perform the essential functions of their jobs.

This CLE will address the specifics of the interactive process and when certain accommodations are "reasonable" or should be denied. Panelists will discuss a wide range of typical requests made by employees for equipment (standing desks, special screens, special key boards, etc.), leaves of absence, elimination of certain parts of their jobs, modified work schedules, work-from-home arrangements, and special travel requests (i.e. first class or ability to Uber to client sites instead of drive).

The discussion also will review the information that employers should obtain from employees when evaluating the reasonableness of the requests. Close Full Description

This CLE program will provide a substantive update on police misconduct cases from the U.S. Supreme Court, U.S. Court of Appeals for the Third Circuit, and the U.S. District Court, Western District of Pennsylvania. The program will cover cases from Jan. 1, 2018 to the present. Included topics will be qualified immunity, excessive force, first amendment retaliatory arrest, malicious prosecution and officer-involved shootings.
